RNLI Complete Guide Download

The RNLI distributes SEA SAFETY: THE COMPLETE GUIDE booklet and interactive CD-ROM free of charge to help people prepare appropriately and act safely when at sea. Before installing this CD you must first agree to the following terms and conditions (“Terms”) by clicking the “I accept the above Terms” tick-box at the bottom of these Terms. If you install or use this CD you will be bound by these Terms.
If you do not accept the Terms you will not be able to continue with the installation and must either return the CD to the RNLI, pass it on to a friend or colleague in accordance with term 2.3 or destroy it. Unwanted CDs can be dropped in to your local RNLI Lifeboat Station or posted to the RNLI at its address below.
The RNLI is a charity registered in England and Wales (209603) and Scotland (SCO37736) with the charity number CHY 2678 in the Republic of Ireland, whose registered office is at West Quay Road, Poole, Dorset BH15 1HZ.

1. In these Terms, the following words have the following meanings:-

“Interactive Guide” – the interactive SEA SAFETY: THE COMPLETE GUIDE as consisting of:-
* either this CD or the download available at www.rnli.org.uk/complete_guide;
* any free updates to the CD or the download made available by the RNLI; and
* all software, applications, images, text, information and other content of this CD, the download or the free updates
“Guide” - SEA SAFETY: THE COMPLETE GUIDE as produced by the RNLI and as consisting of:-
* the Interactive Guide;
* the accompanying booklet and website pages at www.rnli.org.uk/complete_guide;
* any free updates of such accompanying booklet or website pages; and
* all software, images, text, information and other content of the accompanying booklet and website pages and the free updates

2. What you can do with the Guide
2.1. Once you have clicked to indicate that you accept these Terms you can install the Interactive Guide and, provided that you comply with these Terms, you can use the Guide in the manner, and for the purposes, described in these Terms.
2.2. You may:-
2.2.1. Install one copy of the Interactive Guide on your computer;
2.2.2. Make a copy of the Interactive Guide for your own back-up purposes only, provided the copy is kept securely in your possession and is only used to replace the original if it is destroyed or becomes defective;
2.2.3. Use the Guide for your personal non-commercial use and for private study;
2.2.4. Use the Guide to assist with improving your organisation’s sea safety procedures or to provide guidance to your organisation’s volunteers, members, cadets, students or employees;
2.2.5. Print out extracts from the Interactive Guide and accompanying website pages, or copy extracts from the booklet accompanying the CD, for the purposes permitted under terms 2.2.3 and 2.2.4, provided in each case that:- Copyright and source indications are also printed and copied where possible; The materials are not used as part of any other publication; and Any extract is not used in a derogatory or misleading context; and
2.2.6. Download, install and use any free updates to the Guide as may be provided to you by the RNLI from time to time.
2.3. If you think that the Guide would be useful to a friend or colleague please either advise them that the download and accompanying content are available at www.rnli.org.uk/complete_guide or pass the Guide on to them free of charge once you have finished with it. You must only provide your friend or colleague with the original booklet and CD and not a copy of all or part of the Guide. Further copies of the Guide (while it is still in publication) can be obtained from the RNLI direct by emailing your request to seasafety@rnli.org.uk

3. What you can’t do with the Guide
3.1. In order to use the Interactive Guide you need to download and install a software programme called Adobe AIR (a pop-up prompt should appear for this during the installation process for the Interactive Guide if you do not already have this software installed) and before you can do so you must accept Adobe’s terms and conditions. You must not do anything which would breach those terms and conditions.
3.2. Except as expressly allowed by these Terms or any local law, you must not:-
3.2.1. Copy the whole of or any part of the Guide except where such copying is incidental to the normal use of the Interactive Guide or in accordance with terms 2.2.2 or 2.2.5;
3.2.2. Sell, hire, rent, lease, loan, distribute, advertise, expose for sale or hire or provide the whole of or any part of the Guide to a third party in return for payment;
3.2.3. Translate, merge, incorporate, adapt, alter or modify any part of the Guide whether in electronic format or hard copy or permit any third party to do so;
3.2.4. Sub-licence these Terms to any third party;
3.2.5. Attempt to access any software within the Interactive Guide (“Software”) in source code form or in unlocked coding or with comments;
3.2.6. Disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the Software nor attempt to do any such things;
3.2.7. Remove, obscure or alter any copyright notices or trademark notices or other proprietary notices of the RNLI and its licensors on any part of the Guide;
3.2.8. Misrepresent your relationship with the RNLI nor present any false information about the RNLI; nor
3.2.9. Imply that the RNLI endorses any of your products or services.
3.3. Except as expressly allowed by these Terms or any local law, you must not do the following without obtaining the RNLI’s prior permission:-
3.3.1. Obtain more than five copies of the Guide or distribute the Guide or any part of the Guide other than as mentioned at term 2.3;
3.3.2. Use the Guide or any part of it by incorporating it into any other work or publication, whether in hard copy or electronic form; nor
3.3.3. Use the Guide or any part of it in order to provide training for which you are charging a fee or for any other commercial purposes (other than as permitted under term 2.2.4).
3.4. The integrity of the Software is protected by technical protection measures (TPM) so that the intellectual property rights, including copyright, in the Software of the RNLI and its third party licensors are not misappropriated. You must not attempt in any way to remove or circumvent any such TPM, nor to apply, manufacture for sale, hire, import, distribute, sell, nor let, offer, advertise or expose for sale or hire, nor have in your possession for private or commercial purposes, any means whose sole intended purpose is to facilitate the unauthorised removal or circumvention of such TPM.
3.5. If you wish to obtain more than five copies of the Guide to distribute to members, volunteers, students, cadets or employees of your organisation or if you wish to make use of the Guide in any way that is not authorised under these Terms please e-mail your request (including as much detail as possible about your intended use) to seasafety@rnli.org.uk.

4. Your obligations
4.1. You agree:-
4.1.1. Not to do anything with the Guide or any part of the Guide which is prohibited by these Terms;
4.1.2. To supervise and control the use of the Guide and ensure that the Guide is used by your members, volunteers, students, cadets and employees in accordance with these Terms; and
4.1.3. To permit the RNLI and its representatives, at all reasonable times and on reasonable advance notice, to have access to any premises where the Guide is being kept or used (and to all computer equipment at those premises) for the purpose of ensuring that you are complying with these Terms and to remove any copies of the Guide should you be found to be in breach of these Terms.

5. Intellectual property rights
5.1. You acknowledge that all copyright, trade marks and other intellectual property rights in the Guide belong to the RNLI or its licensors and any use of such intellectual property not expressly granted by these Terms is forbidden and may infringe the rights of the proprietor.
5.2. The RNLI name and logo are trade marks of the RNLI. Other logos and names used in the Guide may also be the trade marks of the RNLI or their respective owners. No permission is given by the RNLI in respect of the use of any such trade marks, names or logos and such use may constitute an infringement of the owner's rights.
5.3. Any rights not expressly granted in these Terms are reserved.

6. Warranty and Disclaimer
6.1. Please let us know if the copy of the Interactive Guide you receive does not work. Subject to availability, you can request another copy of the CD or download a copy from www.rnli.org.uk/complete_guide. Please remember that the Guide is distributed and made available for download for free and the RNLI is a charity with limited funds. You may only install and use the Guide if you accept the following provisions designed to protect the RNLI from legal liability.
6.2. You acknowledge that the Interactive Guide is provided free of charge and is provided as it is and it may not be free of bugs, defects or errors.
6.3. The RNLI gives no warranty that the Adobe AIR software is free of defects, bugs or errors or that it is suitable for you.
6.4. The information provided in the Guide is intended to provide general information only and, as such, should not be considered as a substitute for advice covering any specific situation.
6.5. The Guide may contain links to third party websites. Such links are provided for your convenience only. The RNLI may not control such websites and is not responsible for their contents. The mere inclusion of such links does not imply any endorsement of the material on those websites or any association with their operators. If you decide to access any of the third party websites linked to from the Guide, you do so entirely at your own risk. We cannot guarantee that these links will work all the time and we have no control over the availability of the linked pages.

7.1. Nothing in these Terms shall exclude or in any way limit the RNLI's liability for fraud, or for death and personal injury caused by its negligence or breach of statutory duty, or any other liability to the extent that it cannot be excluded or limited as a matter of law.
7.2. The Guide is provided for free and as a condition of you using it you agree that, subject to clause 7.1, the RNLI shall not be liable to you for any loss, damages or costs you incur arising out of your use or installation of the Guide or your reliance on anything in the Guide.
7.3. Subject to clause 7.1 above the RNLI shall not be liable for:-
7.3.1. loss of income;
7.3.2. loss of business profits or contracts;
7.3.3. business interruption;
7.3.4. loss of the use of money or anticipated savings;
7.3.5. loss of information;
7.3.6. loss of opportunity, goodwill or reputation;
7.3.7. loss of, damage to or corruption of data; nor
7.3.8. any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise
arising out of your use or installation of the Guide or your reliance on anything in the Guide.
7.4. The RNLI shall not be liable for any loss or damage caused by the download, installation or use of the Adobe AIR software.
7.5. These Terms set out the full extent of the RNLI's obligations and liabilities in respect of its supply of the Guide. In particular, there are no conditions, warranties, representations or other terms, express or implied, that are binding on the RNLI except as specifically stated in these Terms or as cannot be excluded by law. Any condition, warranty, representation or other term concerning the supply of the Guide which might otherwise be implied into, or incorporated in, these Terms, or any collateral contract, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law.

8. Termination
8.1. The RNLI may terminate your licence to use the Guide immediately if you fail to comply with these Terms, in which case:-
8.1.1. All rights granted to you under these Terms shall cease and you must cease all activities authorised by these Terms; and
8.1.2. You must immediately delete or remove the Interactive Guide from all computer equipment in your possession and any computer equipment used by your organisation’s volunteers, members, cadets, students, employees or representatives and immediately destroy or return to the RNLI all copies of the Guide.

9. Transfer of rights and obligations
9.1. Except as permitted under term 2.3, you may not transfer, assign, charge or otherwise dispose of any of your rights or obligations under these Terms without the RNLI’s prior written consent.
9.2. The RNLI may transfer, assign, charge, sub-contract or otherwise dispose of any of its rights or obligations arising under these Terms.

10. Waiver
10.1. If you breach these Terms and the RNLI takes no action, the RNLI will still be entitled to use its rights and remedies at a later date or in any other situation where you breach these Terms.
10.2. No waiver by the RNLI of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

11. Severability
11.1. If any part of the these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

12. Entire agreement
12.1. These Terms and any document expressly referred to in them represent the entire agreement between us in relation to your use of the Guide.

13. Law and jurisdiction
13.1. These Terms, their subject matter and any disputes regarding your use of the Guide shall be governed by and construed in accordance with English law. You irrevocably submit to the exclusive jurisdiction of the courts of England. This clause shall not limit the RNLI’s right to take proceedings in any other court of competent jurisdiction.
